Terms of Use

These Terms of Use ("Terms") are an agreement between you and Pixoby ("Pixoby", "we", "us") for your use of the Gym mobile app (the "App") and this website (together, the "Service"). By installing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who can use Gym

You must be at least 13 years old, or at least 16 in the European Economic Area, to use Gym. If you are under the age of majority where you live, you may use Gym only with the permission of a parent or guardian, who accepts these Terms on your behalf.

2. Your account

You can use Gym without signing up. The App creates an anonymous account on your device; if you delete the App or change devices without adding an email or signing in with Apple or Google, you may lose access to that data.
Information you give us, such as your bodyweight, age and lifts, should be accurate. Ranks and targets are calculated from it.
You are responsible for keeping your sign-in details secure and for activity on your account. Tell us at info@pixoby.space if you think your account has been compromised.
You can delete your account at any time. See Delete your account and data.

3. Gym Pro subscriptions and free trial

Plans. Gym is free to download and use. Gym Pro is an optional auto-renewing subscription, offered monthly or yearly (currently $4.99 per month or $29.99 per year in the United States; the price for your country is shown in the App before you buy). Prices may change; any change applies from your next renewal and is notified as the App Store or Google Play requires.
Billing. Subscriptions are sold and billed by Apple through the App Store or by Google through Google Play, using the payment method on your store account. Payment is charged when you confirm the purchase, or when a free trial ends.
Automatic renewal. Your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your store account is charged for renewal within the 24 hours before the current period ends.
Free trial. The yearly plan may include a 7-day free trial for eligible users, as shown in the App. If you do not cancel at least 24 hours before the trial ends, the yearly subscription starts and you are charged. Trial eligibility is decided by the App Store or Google Play, and each user can use a trial once.
Cancelling. Manage or cancel your subscription in your App Store or Google Play account settings. After you cancel, Pro stays active until the end of the period you have paid for. Deleting the App or your Gym account does not cancel a subscription.
Refunds. Refund requests are handled by Apple or Google under their own policies. We cannot issue refunds for store purchases ourselves.

4. Health and safety: not medical advice

Gym provides workout tracking, strength rank estimates, recovery guidance, AI-generated workout suggestions and nutrition estimates, including estimates made from barcodes and food photos. All of these are estimates for information and motivation. They are not medical, health or professional training advice, and they may be inaccurate.
Talk to a doctor or another qualified professional before you start a new training or nutrition program, especially if you are pregnant, have a medical condition or injury, or have not trained before.
Train within your abilities, use proper technique and safety equipment such as spotters and safety bars, and stop if you feel pain, dizziness or shortness of breath. Do not use a rank, prediction or AI suggestion as a reason to lift more than you safely can.
Gym is not intended to diagnose, treat or prevent any disease or condition.

5. AI features and third-party data

AI workout generation and AI food photo estimates are produced automatically by third-party AI models and can be wrong. Check every result before you rely on it; you can edit food estimates before saving them. Barcode results come from Open Food Facts, a public database available under the Open Database License (ODbL), and may be incomplete or out of date.

6. User conduct

Gym has public features: display names, usernames, avatars, friends, leaderboards and weekly leagues. You agree not to:

Use a display name or username that is offensive, hateful, sexual, threatening, misleading, impersonates someone else, contains another person's personal information, or advertises anything.
Cheat: log lifts, sets or workouts you did not do, enter false bodyweight or age to inflate ranks, or manipulate XP, streaks, quests or league results.
Use bots, scripts, modified apps or any automated means to access the Service, or exploit bugs instead of reporting them.
Harass, threaten or spam other users, including through friend requests.
Interfere with the Service's security or operation, access other users' accounts or data, or reverse engineer the App except where the law allows it.
Use the Service for anything unlawful.

7. Reporting, blocking and moderation

You can report or block another user in the App. We review reports and may, at our discretion and without notice, change or remove display names and usernames, remove content, reset or remove ranks, XP, streaks or league results gained by breaking these Terms, remove users from leagues or leaderboards, and suspend or terminate accounts. Where the law requires it, we will tell you the reason for a restriction and how to contest it by writing to info@pixoby.space.

8. Your content

You keep ownership of what you put into Gym, such as your logs, routines, display name and meal photos ("Your Content"). You give Pixoby a non-exclusive, worldwide, royalty-free license to host, store, process and display Your Content only as needed to operate and improve the Service, for example to show your display name and weekly XP on leaderboards. This license ends when Your Content is deleted, except for copies kept for a limited time in backups as described in the Privacy Policy. You are responsible for Your Content and confirm that you have the right to use it.

9. Our rights and your license to use Gym

The Service, including its software, design, rank system, text, graphics and the Barry mascot, belongs to Pixobyor its licensors. Subject to these Terms, we give you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your own non-commercial use.

10. App Store and Google Play

If you downloaded the App from the Apple App Store, your use of the App is also governed by Apple's Licensed Application End User License Agreement (Standard EULA), which is the end user license agreement for the iOS App. These Terms are between you and Pixoby, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to the App, including product liability claims, claims that the App fails to meet any legal or regulatory requirement, consumer protection claims, and intellectual property infringement claims. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you downloaded the App from Google Play, purchases are also subject to the Google Play Terms of Service.

11. Changes to the Service

We keep improving Gym and may add, change or remove features, including how ranks, leagues and quests are calculated. If we remove a core Pro feature you have paid for, we will tell you in advance where possible.

12. Ending these Terms

You can stop using Gym and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or if we stop offering the Service, in which case we will give reasonable notice where possible. Sections 4, 5, 8 (for content already shared), 13, 14 and 15 continue to apply after these Terms end.

13. Disclaimers

To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose, accuracy of ranks and estimates, or uninterrupted, error-free operation. Some jurisdictions do not allow these exclusions, so they may not fully apply to you, and nothing in these Terms affects your statutory rights as a consumer.

14. Limitation of liability

To the extent permitted by law, Pixoby is not liable for indirect, incidental, special or consequential damages, or for loss of data or profits, arising from your use of the Service, and our total liability for any claim relating to the Service is limited to the amount you paid for Gym Pro in the 12 months before the claim, or USD 50 if that is more. We do not limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

15. Disputes and governing law

If you have a problem with Gym, contact us first at info@pixoby.space and we will try to resolve it informally. These Terms are governed by the law of the place where Pixoby is established, except that, if you are a consumer, you keep the protection of the mandatory laws of the country where you live and may bring a claim in its courts.

16. Changes to these Terms

We may update these Terms. We will change the "Last updated" date above and, for material changes, tell you in the App before they take effect. If you keep using Gym after that, the updated Terms apply.
